TERMS AND CONDITIONS
1. Information on how eligible customers can redeem the Offer forms part of these Terms and Conditions.
2. To be eligible to receive your six family movie passes, each for 1 Disney movie (the ‘Offer’) you must have booked 2 rooms at a participating Novotel hotel or resort in Australia (the first room on the Family Best Unrestricted Rate and the second room on 50% off the Family Best Unrestricted Rate for use of children only) between 11 February and 31 March 2010 for stays between 11 February and 31 May 2010. This Offer is available for stays of a minimum of 2 nights and a maximum of 5 nights. Passes will not be provided if the booking is cancelled. This Offer is available to Australian residents only for bookings made on novotel.com and accorhotels.com only. Eligible customers are able to print movie passes online and redeem these passes for tickets in accordance with the instructions on the pass. For more information on the Offer visit www.novotel.com.
3. Eligible Customers will receive six family movie passes to Disney films nominated by Disney following the release of each nominated movie in Australia, which will occur during 2010 (possibly into 2011). Following each movie release eligible customers will receive an SMS message or email with a unique code for each movie. This code can be activated and the movie pass printed from this website. This code can only be used once.
4. Each family movie pass entitles the eligible customer to tickets with a recommended retail price of up to AUD$59.00 and is redeemable at participating cinemas, subject to seating availability. The family movie pass and any tickets for which it is redeemed are non-refundable and cannot be exchanged or replaced if lost or stolen. Change will not be given irrespective of cinema pricing. The family movie pass is valid in Australia for one family admission (2 adults and 2 children or 1 adult and 3 children) to a screening of the nominated Disney film on the family movie pass up to the value of AUD$59.00. The family movie pass expires on the date specified on the family movie pass or when the film stops screening in cinemas, whichever happens first. The family movie pass is not transferable or redeemable for cash. No reproductions will be accepted. Not valid for Gold Class, VMAX, 3D/Real D, La Premiere, Directors Suite, thehalfpipe, Hoyts IMAX ®, 3D, xtremescreen, alternative content, special events or in conjunction with any other offer or promotion. Redemption of the family pass for admission is subject to availability. Participating cinemas are listed elsewhere on this site.
5. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury sustained, as a result of taking up the Offer, except for any liability which cannot be excluded by law.
6. During the course of the promotion, the Promoter may collect personal information in relation to eligible customers. This may include, but is not limited to, the names, email addresses, telephone numbers and credit card details of the customers, provided by the customer when making a booking or when paying for services provided by the participating hotel. The Promoter may disclose personal information from eligible customers to other companies associated with this promotion to enable eligible customers to participate and receive the Offer.
7. Unless otherwise advised by the customer, each customer consents to the retention and use of the information collected by the Promoter, which is part of the Accor Group. For details about who we are, how we may use your information and what your rights are under the new privacy laws, please see our Privacy Policy, which is available from the Promoter at Level 30, 123 Pitt Street, Sydney or online at www.accorhotels.com. Uses may include future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the customer, or distribution of marketing materials for goods or services in the tourism, hospitality and services industries from the Accor Group.
8. If for any reason this Offer is not capable of proceeding as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity, or proper conduct of this Offer, the Promoter reserves the right in its sole discretion, to disqualify any individual who tampers with the login process, and to terminate, modify or suspend the Offer.
9. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, Internet logins. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or login on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in relation to the Offer.
